FMLA Military Caregiver Leave¶
Extension of FMLA providing up to 26 weeks of unpaid, job-protected leave in a single 12-month period for an eligible employee to care for a covered servicemember or veteran with a serious injury or illness.
Up to 26 weeks of unpaid, job-protected leave in a single 12-month period to care for a covered servicemember with a serious injury or illness. This is inclusive of the standard 12 weeks of FMLA leave. Covered servicemembers include current Armed Forces members (including National Guard and Reserves) and veterans discharged within the preceding 5 years. Covered relationships include spouse, son, daughter, parent, or next of kin (nearest blood relative).
Eligibility¶
- Care recipient must have a qualifying disability
- Care recipient must be a veteran
- Employer must have 50+ employees
- Must have worked 1250+ hours
- Relationship: spouse, parent, child, other relative
