FMLA Military Caregiver Leave

Extension of FMLA providing up to 26 weeks of unpaid, job-protected leave in a single 12-month period for an eligible employee to care for a covered servicemember or veteran with a serious injury or illness.

Up to 26 weeks of unpaid, job-protected leave in a single 12-month period to care for a covered servicemember with a serious injury or illness. This is inclusive of the standard 12 weeks of FMLA leave. Covered servicemembers include current Armed Forces members (including National Guard and Reserves) and veterans discharged within the preceding 5 years. Covered relationships include spouse, son, daughter, parent, or next of kin (nearest blood relative).

Eligibility

  • Care recipient must have a qualifying disability or need for assistance
  • Care recipient must be an eligible veteran
  • Employer must have at least 50 employees
  • Must have worked at least 1,250 hours in the past 12 months
  • No income test required
  • No asset test required
